Erie Police Officer Charged With DUI Waives All Charges Against Him

The case moves forward against the Erie police officer, charged with driving drunk and slamming into the back of an Erie fire truck.

An Erie police officer remains on leave as the first steps in the court process take place Wednesday, on charges he drove drunk and crashed, while off-duty. 

28-year-old rookie officer, Gabriel Carducci, is charged with DUI.

WICU & WSEE had the only cameras there today as he waived all the charges against him, including DUI, careless driving, and hitting an emergency vehicle with its lights flashing.

Carducci left District Judge Dominick DiPaolo's office with his lawyer, Dave Ridge, after waving all the charges ahead of his preliminary hearing, scheduled for Thursday.

Police say he hit an Erie fire truck, as it backed into the fire station, around 5:00 a.m. on Thanksgiving morning. 

That crash caused thousands of dollars in damage to the truck.

At the scene, Carducci allegedly failed three field sobriety tests, and according to the criminal complaint, his blood alcohol limit was .16. 
That's twice the legal limit to drive, of .08. 

Carducci was on administrative leave at the time of the crash, for a previous off-duty incident, that was investigated by other agencies.
However, after a lengthy investigation, Erie's District Attorney Jack Daneri decided no charges will be filed, as there wasn't enough evidence.
Daneri would not specify details on those allegations. 

Even though these criminal charges against Carducci have moved forward, that doesn't necessarily mean he'll lose his job as a police officer, as he could go through a rehabilitation process.
