DEP Gets Chance to Respond to Erie Coke's Request to Admit Additional Evidence
The fate of the Erie Coke plant now rests in the hands of a judge from Pennsylvania's Environmental Hearing Board.
Erie News Now has learned the Department of Environmental Protection has until Monday to respond to the latest petition.
Attorneys from Erie Coke Corporation and the DEP submitted their closing briefs Thursday to Judge Stephen Beckman.
The company also petitioned the court to allow two new documents to be entered into evidence.
An order was issued Thursday giving the DEP until Monday to respond to the request to admit new evidence.
Judge Beckman is expected to make a ruling soon on whether the plant's can stay open.
