The Pennsylvania House Children & Youth Committee has unanimously approved House Bill 928, a bipartisan effort to require food allergy training, emergency planning, and access to life-saving medication in daycare facilities.

Known as Elijah’s Law, the bill is named after 3-year-old Elijah Silvera, who died from an allergic reaction at his daycare.

The legislation is co-sponsored by Reps. Bridget Kosierowski (D-Lackawanna) and Kristin Marcell (R-Bucks).

“As a nurse, I understand how critical training and immediate access to epinephrine can be during an allergic reaction,” said Kosierowski. “This bill will save lives.”

Marcell, whose child has severe allergies, added, “No parent should fear that their child won’t get timely care. This bill equips daycare staff with the tools to respond confidently when it matters most.”

The bill now heads to the full House for consideration.

Elijah’s Law has already been enacted in several other states, including New York, Maryland, and California.
