Pennsylvania Attorney General Dave Sunday has joined a bipartisan coalition of 28 Attorneys General in a lawsuit to stop DNA testing company 23andMe from selling consumer genetic data as part of its bankruptcy proceedings.

The lawsuit, filed June 9 in federal bankruptcy court, aims to block the sale of highly sensitive personal data, including genetic and health-related information, without informed consent from consumers.

“Pennsylvanians who trusted 23andMe with their DNA did not sign up to have that information sold to the highest bidder,” said AG Sunday. “We are taking action to ensure that deeply personal data remains protected.”

23andMe, which recently filed for bankruptcy, is seeking to auction off its assets, including consumer data, prompting privacy concerns and legal challenges. AG Sunday encouraged customers to consider deleting their information from the company’s database.

Consumers affected by the bankruptcy have until July 14, 2025, to file a proof of claim.
