A Corry man will no longer face charges in his son’s shooting death, Erie County District Attorney Elizabeth Hirz announced Tuesday.

Hirz said she has dismissed the homicide charges against Gary Hulihan. The investigation determined he acted in lawful self-defense during an Aug. 11 incident at his home in Corry.

Authorities say Gary and his son, Patrick Hulihan, had an argument that turned physical. Patrick, visiting from Michigan, allegedly punched his father and followed him into the house. The confrontation escalated to a struggle over a firearm in Gary’s bedroom, where Patrick was fatally shot.

Initially, Gary Hulihan was charged with several crimes, including criminal homicide. But after reviewing evidence, witness statements, and forensic results, prosecutors said they concluded Gary reasonably believed he was in imminent danger, and under Pennsylvania law, his actions were deemed justified.

District Attorney Hirz called the decision to dismiss the case “right and just under the law.”
