Prior incidents of intimidation that Defendant has committed against Plaintiff or the minor child/ren, (including any threats, injuries, or incidents of stalking) are as follows:

Approximate Date: Jan. 2023 Approximate Time: 6 p.m.

[The Plaintiff] Defendant, myself and 2 children were sitting at table having dinner. My son said something that Defendant felt was disrespectful. He yelled "Don't talk that way, boy" my son got up to leave table Defendant followed him, grabbed him by the back of the  neck, walked him back to his seat and forcefully pushed him down on the chair. My son was crying and Defendant continued to tell me to "be a man." [END]

[The Plaintiff] April 2022 - Defendant dragged my daughter by her sweatshirt from one room into her bedroom. Defendant then picked my daughter up and threw her on her loft bed. My daughter hit her head on the wall and while Defendant was trying to throw her on her bed my daughter tried to fight back and Defendant chipped his front tooth because of her trying to make him stop. [END]

[The Plaintiff] June/July 2022 - We were all setting ready to leave my house and my son said something that Defendant didn't like. I didn't hear what was said b/c I was walking from kitchen to the backroom where Defendant and my son were. As I walked into back room I saw Defendant grab my sons throat and body slam him hard on the ground. Defendant continued to yell about disrespect and how my son needs to act like a man.

Oct. 2022 - Defendant took kids to school b/c they missed bus. As a punishment he made my kids get out of his car with their book bags. The kids walked up the Hill on Flower Rd. as he was following in his car my neighbors drove past and called me to tell me that they just saw the kids walking up the hill with Defendant following them. My neighbors stopped him and pulled over to ask what was going on. He laughed and said they missed the bus and this was their punishment. After I hung up with my neighbor Defendant calls me and tells me had a "run in" with my neighbors trying to tell him how to discipline the kids. My neighbors said my son was visibly crying and my daughters face was red and her head down as she walked. A school bus drove by and Defendant took a video of the kids walking, mocking and ridiculing them. When I asked my kids about the incident later that evening they did not want to discuss. [END]

May 2022 - Defendant was upset because kids were muddy from playing outside. We had to get in the car to drive home from Defendant's parents house. Defendant instructed my son to take off his pants so he didn't get mud in my car. My son felt uncomfortable with that because of the people around. The Defendant then walked over to my son grabbed him by [the] back of [his] neck, turned him and body slammed him to the ground yelling at him saying "stop acting like a p****" My son was crying and very shaken up. Thurs. after incident my son had his regular counseling appt. During that appt. my son told the counselor about the choking and body slamming incident. My son's counselor ChildLined the incident that evening. Friday - Defendant and I were doing yard work at my house, my parents and defendant's co-worker were over. A man walked up to the house and asked if I was [the Plaintiff] I said yes, Defendant ran over and said you aren't taking her anywhere. After the man said he was sent by OCY, from Harrisburg b/c OCY (Erie Co.) couldn't due to conflict of interest. Then man spoke with me first, my son and then the Defendant. After the man left the Defendant said "it's all taken care of." The man confirmed there was nothing to report. Defendant also said "he was going to ensure any does involving case would disappear." He called the Director of OCY and explained situation.

Erie County Executive Brenton Davis's spokesperson Dennis Roddy released the following statement regarding the matter:

Mr. Davis was awakened at 7 a.m. Easter Sunday with a loud banging at the door. He observed the plaintiff at his front door. She then forced her way into the house with a rifle that appeared to be loaded. He immediately disarmed her.
The plaintiff informed him that she had come to return a hunting rifle that he had permitted her son to use during hunting season. At the time she appeared, he had no idea as to the origins or ownership of the weapon and was understandably concerned for his safety. The rifle could have been safely returned by a third party without disruption or implicit threats.
After approximately 45 minutes, Mr. Davis was able to persuaded her to leave his home. He remained uncertain as to whether she was in possession of any other weapons.
During the course of their relationship, the plaintiff's conduct became increasingly erratic. After she departed his home on Easter Sunday, Mr. Davis examined surveillance tapes of his residence and discovered that the plaintiff had come to his home, armed with the rifle, multiple times on the previous night.
Mr. Davis had previously advised her not to come to his home.
Mr. Davis unequivocally denies any wrongdoing.
